⚠️ Read This Before You Lend or Borrow

RightHelp is a record-keeping tool — not a bank or regulated lender. If you lend money through this platform and the borrower does not repay, RightHelp cannot recover your money for you. Only lend what you can afford to lose. Never lend to someone you do not know and trust personally.

1. RightHelp is Not a Regulated Financial Service

RightHelp is a software platform designed to help individuals record and manage private loan agreements. It is not a bank, building society, credit union, peer-to-peer lending platform, electronic money institution, or payment service provider.

RightHelp is not authorised or regulated by the Financial Conduct Authority (FCA) or any other financial services regulator. It does not carry out any regulated activity as defined under the Financial Services and Markets Act 2000 (FSMA).

As a result, users of RightHelp are not entitled to protection under:

  • The Financial Services Compensation Scheme (FSCS)
  • The Financial Ombudsman Service (FOS)
  • Any statutory consumer protections that apply to regulated credit agreements

2. RightHelp Does Not Hold or Transfer Money

RightHelp does not at any point hold, transfer, receive, disburse, or facilitate the movement of funds on behalf of users. All money transfers in connection with any loan recorded on the platform are made directly between users via their own bank accounts or other payment methods, entirely outside of and independent from this platform.

RightHelp has no access to, control over, or involvement in any actual financial transaction.

3. Lending Risk — You May Lose Your Money

Lending money to another person — even someone you know and trust — carries the risk of non-repayment. RightHelp does not guarantee, insure, or underwrite any loan recorded on the platform.

If a borrower fails to repay:

  • RightHelp will not repay you or recover the money on your behalf
  • RightHelp will not pursue the borrower or take any legal action
  • RightHelp will not mediate or adjudicate in any dispute

Your only recourse is through civil legal channels — such as a Small Claims Court claim or seeking legal advice — which you would pursue independently.

Only lend money you can afford not to get back.

4. Borrowing Responsibility — You Are Legally Obligated to Repay

By recording a loan agreement on RightHelp, the borrower acknowledges that the loan is a real financial obligation. Failure to repay a loan may:

  • Constitute a breach of contract, exposing you to civil legal action
  • Damage your personal relationships and community standing
  • In some circumstances, constitute fraud if funds were obtained by deception

Do not borrow more than you can afford to repay within the agreed timeframe.

5. No Financial Advice

Nothing on RightHelp — including any interest rate suggestions, repayment schedule calculations, budgeting tools, savings goal features, or any other content, text, or feature — constitutes financial, legal, investment, or tax advice.

All features are provided as general-purpose tools based on user-entered data. You should seek independent professional advice from a qualified financial adviser, solicitor, or accountant before entering into any loan arrangement, particularly where significant sums of money are involved.

6. Interest and Consumer Credit Law

In the United Kingdom, lending money at interest to consumers on a commercial basis is a regulated activity under the Consumer Credit Act 1974 and the Financial Services and Markets Act 2000. Private individuals lending to other private individuals on a non-commercial, personal basis are generally not subject to these regulations, but the line can be complex.

If you intend to charge interest on a loan, you should seek legal advice to confirm that your arrangement does not constitute regulated activity. RightHelp does not provide any assurance on this point.

7. Tax on Interest Income

Interest received on private loans may be subject to Income Tax in the UK. Under HMRC rules, individuals may receive up to £1,000 of savings and interest income tax-free per year (the Personal Savings Allowance), but amounts above this threshold must be declared.

RightHelp does not calculate, report, or file tax information on your behalf. It is your sole responsibility to declare interest income to HMRC and meet any tax obligations arising from loan arrangements recorded on the platform. Consult HMRC or a qualified tax adviser if you are unsure.

8. Rotating Savings Groups (Susu / Esusu / Ajo)

The susu feature is a coordination and scheduling tool only. RightHelp does not hold group funds in escrow or any other account. Group funds are held and managed entirely by the group organiser and/or members.

Risks of rotating savings groups include:

  • A member failing to contribute in their round
  • The organiser absconding with collected funds
  • Disputes over payout order or timing

RightHelp accepts no liability for any loss arising from participation in a rotating savings group coordinated through the platform. Participants do so entirely at their own risk.

9. No Identity or Creditworthiness Verification

RightHelp does not verify the identity, address, creditworthiness, employment status, or any other personal attribute of any user. The information displayed on a user's profile or within a loan agreement is self-reported and has not been checked or validated by RightHelp.

You should conduct your own due diligence before agreeing to lend to or borrow from any person.

10. Platform Availability

RightHelp is provided on an "as is" and "as available" basis. We do not guarantee continuous, uninterrupted access to the platform. In the event of technical issues, data loss, or service disruption, RightHelp shall not be liable for any resulting loss, inconvenience, or financial harm.

We recommend that users keep independent records of all loan agreements they enter into, separate from the platform.

11. Dispute Resolution

RightHelp will not intervene in, mediate, or adjudicate disputes between users. If a dispute arises in connection with a loan or savings arrangement, the parties must seek resolution independently. Options available to individuals in the UK include:

  • Small Claims Court (claims up to £10,000 in England and Wales)
  • Mediation services offered by organisations such as the Centre for Effective Dispute Resolution (CEDR)
  • Legal advice from a solicitor
  • Citizens Advice for guidance on civil money claims

12. Changes to This Disclaimer

We may update this disclaimer from time to time to reflect changes in law, regulation, or platform features. We will notify users of material changes where possible. Continued use of the platform constitutes acceptance of the updated disclaimer.

Summary for clarity: RightHelp helps you track and organise loans — nothing more. The money is yours, the risk is yours, and the responsibility is yours. Use the platform as a helpful tool, but always make financial decisions carefully and with people you genuinely trust.
