Terms & Conditions

⚠️ Important — Please Read Before Using RightHelp

RightHelp is not a bank, lender, or regulated financial service. It is a record-keeping and coordination tool. All loans are private agreements between individuals. RightHelp does not hold funds, guarantee repayment, or provide financial advice. You use this platform entirely at your own risk.

1. About RightHelp

RightHelp ("we", "us", "our") is a digital platform that enables individuals to record, track, and coordinate personal loan agreements between people they know and trust. RightHelp is operated as a software tool only.

RightHelp is not a lender, bank, credit broker, payment institution, or any form of regulated financial service provider. We are not authorised or regulated by the Financial Conduct Authority (FCA) or any other financial regulatory body.

By creating an account and using RightHelp, you confirm that you have read, understood, and agree to these Terms & Conditions in full. If you do not agree, you must not use the platform.

2. Eligibility

To use RightHelp, you must:

  • Be at least 18 years of age
  • Be legally capable of entering into binding contracts in your jurisdiction
  • Be acting in a personal capacity, not as a commercial lender or financial institution
  • Provide accurate, truthful, and complete information when registering

By registering, you represent and warrant that all of the above conditions are met.

3. Nature of the Service — What RightHelp Does and Does Not Do

RightHelp provides tools to:

  • Record and display loan agreement details entered by users
  • Generate and track repayment schedules based on user-entered data
  • Send payment reminders via the platform
  • Coordinate rotating savings groups (commonly known as susu, esusu, ajo, or chit funds)
  • Track personal budgets, income, expenses, and savings goals

RightHelp does NOT:

  • Transfer, hold, receive, or disburse any money on behalf of users
  • Verify the identity, creditworthiness, or trustworthiness of any user
  • Guarantee or underwrite any loan or savings arrangement
  • Provide financial, legal, investment, or tax advice
  • Act as an intermediary or party to any loan agreement
  • Intervene in or mediate disputes between users

All financial transactions occur directly between users, entirely outside of the platform. RightHelp has no visibility into, or control over, actual money movements.

4. Your Financial Responsibilities

By using RightHelp, you acknowledge and accept full responsibility for:

  • Loan agreements: Any loan you enter into with another user is a private legal agreement between you and that individual. RightHelp is not a party to it.
  • Repayment: If you borrow money, you are legally and morally obligated to repay it in accordance with the terms you agreed. Failure to repay may expose you to civil legal action by the lender.
  • Due diligence: As a lender, you are responsible for assessing the trustworthiness of the person you lend to. RightHelp does not perform credit checks or verify user identities.
  • Legal compliance: You must ensure that any loan arrangement you enter into complies with all applicable laws in your jurisdiction, including rules on private lending, interest rates (e.g. the Consumer Credit Act 1974 in the UK), and anti-money laundering regulations.
  • Tax obligations: Interest income earned from private loans may be taxable. You are solely responsible for understanding and meeting your tax obligations. Consult HMRC or a qualified tax adviser if in doubt.
  • Accuracy of records: You are responsible for the accuracy of all information entered into the platform. RightHelp displays what you input — we cannot verify it.

5. Rotating Savings Groups (Susu)

The susu/rotating savings group feature is a coordination tool only. It allows users to organise contribution schedules and track payouts within a group.

RightHelp does not:

  • Hold group funds in any account
  • Guarantee that any member will make their contribution
  • Guarantee that any payout will be made
  • Take responsibility for defaults, disputes, or losses within any group

All contributions and payouts are made directly between group members. Participants join and operate susu groups entirely at their own risk.

6. Limitation of Liability

To the fullest extent permitted by applicable law, RightHelp and its operators, directors, employees, and agents shall not be liable for any loss, damage, or claim arising from:

  • Unpaid or defaulted loans between users
  • Disputes, conflicts, or broken agreements between users
  • Reliance on any information, calculation, or schedule displayed on the platform
  • Loss of access to the platform or data held within it
  • Errors in user-entered data
  • Any indirect, consequential, or economic loss of any kind

RightHelp is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement.

Where liability cannot be excluded by law (for example, for fraudulent misrepresentation), our liability is limited to the maximum extent permitted by law.

7. Prohibited Use

You must not use RightHelp to:

  • Facilitate illegal lending, usury, or unlicensed consumer credit activity
  • Launder money or process funds from criminal activity
  • Commit fraud, misrepresentation, or identity theft
  • Harass, threaten, or abuse other users
  • Violate any applicable local, national, or international law or regulation
  • Enter false or misleading information into the platform

We reserve the right to suspend or permanently terminate accounts where misuse is suspected, without notice and without liability.

8. No FCA Regulation — Your Protections

Because RightHelp is not FCA-regulated, you should be aware that:

  • You cannot make a complaint to the Financial Ombudsman Service (FOS) in relation to your use of this platform
  • You are not covered by the Financial Services Compensation Scheme (FSCS)
  • You do not have statutory rights that would apply to regulated financial products

All recourse for disputes or losses must be pursued through civil legal channels between the parties involved.

9. Data and Privacy

We collect and process personal data in accordance with our Privacy Policy. By using RightHelp, you consent to such processing. You are responsible for ensuring that any personal data you record about third parties (e.g. a borrower's name or email) is shared with their knowledge and consent.

10. Intellectual Property

All content, design, software, and functionality of RightHelp is the intellectual property of its operators. You may not copy, reproduce, or distribute any part of the platform without prior written permission.

11. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, particularly where these Terms are breached. You may request deletion of your account by contacting us. Termination does not affect any obligations or loan agreements already recorded.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of the platform after any change constitutes your acceptance of the revised Terms. We will endeavour to notify users of material changes via email where possible. It is your responsibility to review these Terms periodically.

13. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
